In 2018, the firm filed a lawsuit on behalf of a sales employee seeking to recover unpaid commissions. Specifically, the lawsuit alleged the employer did not pay the employee any of his commission tails after separation from employment. Tailing commissions are common in industries in which customers pay on a monthly basis.  The lawsuit also alleged that certain customer accounts on which commissions were exposed to be paid were improperly re-categorized from accounts the sales employee generated to “house” accounts. The alleged unlawful re-categorization of some accounts to “house” accounts reduced the amount of commissions that were otherwise due to the employee.
